Terms of Service

These Terms of Service govern your access to and use of Mosik AI’s websites, artificial intelligence voice agents, messaging tools, dashboards, APIs, integrations, automation services, and related products and features collectively referred to as the “Services.”
Please read these Terms carefully. By creating an account, requesting a demonstration, purchasing Services, accessing the Mosik AI platform, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.
1) Acceptance and scope
- Agreement: These Terms form a legally binding agreement between you and Mosik AI regarding your use of the Services.
- Business use: The Services are primarily designed for businesses and authorized business representatives.
- Organization authority: If you access or use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
- Additional terms: Certain products, integrations, trials, orders, or regulated use cases may be governed by additional written terms. When additional terms conflict with these Terms, the additional terms control only for the applicable product or service.
2) Eligibility
- You must be at least 18 years old and legally capable of entering into a binding agreement.
- You may not use the Services when prohibited by applicable law, regulation, sanctions, court order, or contractual restriction.
- You represent that the information you provide about yourself and your business is complete, accurate, and not misleading.
3) Accounts and account security
- Account creation: Certain Services require an account. You must provide accurate contact, business, billing, and identity information when requested.
- Credentials: You are responsible for protecting your passwords, API keys, authentication credentials, access tokens, and connected-account credentials.
- Authorized users: You are responsible for the actions of employees, contractors, administrators, and other persons who access the Services through your account.
- Unauthorized access: You must promptly notify Mosik AI at hello@mosikai.com when you reasonably suspect unauthorized account access or misuse.
- Contact information: Providing a telephone number does not by itself constitute consent to receive SMS messages. SMS consent is collected separately through an optional, unchecked consent checkbox.
4) Description of the Services
Mosik AI may provide artificial intelligence and automation tools that assist businesses with telephone calls, customer communications, appointments, orders, lead handling, account support, follow-ups, integrations, and other business workflows.
- Voice agents: AI agents may answer inbound calls or place outbound calls according to instructions and configurations supplied by the customer.
- Messaging tools: The Services may support transactional SMS, account notifications, support communications, or other messaging uses configured by the customer.
- Dashboards and APIs: Customers may access dashboards, APIs, logs, settings, usage information, integrations, and automation controls.
- Integrations: The Services may connect with customer relationship management platforms, calendars, payment providers, telecommunication providers, point-of-sale systems, webhooks, or other third-party tools.
- Service changes: Mosik AI may improve, modify, replace, limit, or discontinue particular features as the platform develops.
5) Mosik AI SMS Program
This section applies to SMS messages sent directly by Mosik AI to individuals who separately consent to receive such messages.
- Program name: Mosik AI SMS Program.
- Program description: When you submit a demo or contact request and separately select the optional SMS consent checkbox, Mosik AI may send one transactional text message regarding that specific request.
- Separate consent: Providing a mobile telephone number, creating an account, accepting these Terms, or requesting a telephone call does not by itself constitute SMS consent.
- Optional consent: SMS consent is not a condition of purchasing products, receiving Services, submitting a request, or communicating with Mosik AI.
- Message frequency: Message frequency is one message per request.
- Charges: Message and data rates may apply according to the terms of your mobile carrier and service plan.
- Opting out: Reply STOP to opt out of further SMS communications from the applicable Mosik AI messaging program.
- Help: Reply HELP for assistance or contact hello@mosikai.com.
- Carrier responsibility: Carriers are not liable for delayed or undelivered messages.
- Number ownership: You represent that you are the subscriber or authorized user of the mobile number you provide. You agree to notify Mosik AI when the number is reassigned, disconnected, or no longer controlled by you.
- Consent limitations: SMS consent applies only to the messaging program and subject matter presented when you provided consent. Consent is not transferable to another person, business, affiliate, campaign, or unrelated purpose.
- Privacy: Mobile telephone numbers, SMS opt-in information, and messaging consent are handled according to our Privacy Policy.
Mosik AI does not sell, rent, transfer, or share SMS consent for third parties’ or affiliates’ marketing or promotional purposes.
6) Telephone calls and voice communications
- Requested calls: When you request a telephone call, you authorize Mosik AI to contact the telephone number you provided regarding that request.
- Automated technology: A call may be placed or handled using automated technology or an artificial intelligence voice agent when disclosed or otherwise permitted by applicable law.
- Call consent: Customers are responsible for obtaining all legally required permissions before using the Services to call another person.
- Do-Not-Call requirements: Customers must comply with applicable federal and state Do-Not-Call requirements and maintain any legally required suppression lists.
- No emergencies: The Services are not designed or approved for emergency communications, emergency dispatch, or access to 911 services.
7) Recordings, transcripts, and disclosure requirements
- Recording features: The Services may permit customers to record, transcribe, summarize, or analyze calls.
- Customer responsibility: The customer is responsible for determining whether recording, transcription, monitoring, or analysis is lawful in each applicable jurisdiction.
- Notices and consent: Customers must provide all required notices and obtain all required one-party, all-party, employee, caller, consumer, patient, or other consent before recording or transcribing communications.
- Configuration: Mosik AI may provide configurable notices or announcements, but the customer remains responsible for confirming that the selected notice is legally sufficient.
- Sensitive information: Customers should avoid collecting unnecessary sensitive personal information through calls, transcripts, prompts, or recordings.
8) Customer responsibilities and legal compliance
You are responsible for your use of the Services, the instructions you provide to AI agents, and communications initiated through your account.
- Obtain all necessary permissions, consents, authorizations, and licenses before contacting individuals.
- Maintain reasonable evidence of consent when consent is required.
- Honor opt-out, unsubscribe, revocation, and Do-Not-Call requests promptly.
- Clearly identify the business responsible for a call, text message, or other communication.
- Ensure campaign descriptions, sample messages, call scripts, sender identities, websites, policies, and actual traffic are accurate and consistent.
- Comply with applicable communications, telemarketing, privacy, advertising, consumer-protection, accessibility, recording, and data-protection requirements.
- Do not rely on Mosik AI as legal, compliance, medical, financial, or emergency-services counsel.
9) Prohibited uses
You may not use or permit another person to use the Services for:
- Illegal, fraudulent, deceptive, misleading, abusive, threatening, harassing, hateful, discriminatory, or harmful conduct.
- Unsolicited calls, text messages, spam, or marketing communications sent without legally sufficient consent.
- Impersonation, caller-ID spoofing, false sender identification, or concealment of the party responsible for a communication.
- Phishing, credential theft, malware distribution, unauthorized surveillance, or attempts to gain unauthorized access to accounts or systems.
- Infringement of intellectual property, privacy, publicity, or other legal rights.
- Collection or processing of sensitive information without an appropriate legal basis and reasonable safeguards.
- Emergency communications, emergency dispatch, or representations that the Services can replace 911 or other emergency services.
- Circumventing usage limits, security controls, carrier restrictions, account suspensions, or compliance safeguards.
- Reverse engineering, unauthorized scraping, penetration testing, excessive automated requests, or disruption of the Services without written permission.
- Any activity that exposes Mosik AI, its providers, carriers, customers, or users to unreasonable legal, security, operational, or reputational risk.
10) Artificial intelligence limitations
- Probabilistic outputs: Artificial intelligence systems may produce inaccurate, incomplete, unexpected, delayed, or inappropriate responses.
- Customer review: You are responsible for reviewing scripts, prompts, settings, knowledge sources, integrations, workflows, and agent behavior before production use.
- No professional advice: AI-generated output is not a substitute for qualified legal, medical, financial, tax, safety, or other professional advice.
- Human oversight: You must maintain appropriate human supervision for high-impact, regulated, safety-sensitive, or customer-facing workflows.
- Customer decisions: You are responsible for decisions, statements, offers, commitments, reservations, orders, payments, instructions, and other actions taken through your configured agents.
11) Third-party services and integrations
- The Services may depend on telecommunications carriers, hosting providers, AI providers, payment processors, calendar providers, customer-management platforms, and other third-party services.
- Third-party services are governed by their own contracts, privacy policies, availability, technical limitations, and acceptable-use requirements.
- By enabling an integration, you authorize Mosik AI to transmit and receive information as reasonably necessary to operate the integration.
- You are responsible for ensuring that you have authority to provide credentials, data, instructions, and access to each connected service.
- Mosik AI is not responsible for third-party outages, security incidents, changes, suspensions, data loss, pricing, or service limitations outside Mosik AI’s reasonable control.
12) Fees, usage, billing, and taxes
- Fees: You agree to pay the fees shown in your order, dashboard, invoice, checkout page, or other applicable written agreement.
- Usage charges: Charges may be based on minutes, messages, telephone numbers, integrations, usage, subscriptions, setup work, or other metered features.
- Minutes wallet: When applicable, purchased or allocated minutes are added to your account and reduced as Services are used.
- Third-party charges: Carrier, messaging, payment, international, premium, or integration charges may apply when disclosed.
- Payment authorization: You authorize Mosik AI and its payment providers to charge the payment method associated with your account for authorized fees.
- Automatic renewal: A recurring subscription or automatic recharge will renew or charge according to the terms displayed when you activate it. You may disable future renewal or recharge through available account controls, subject to processing time.
- Taxes: Fees generally exclude applicable taxes, duties, assessments, or governmental charges unless expressly stated otherwise.
- Payment failure: Mosik AI may limit or suspend Services when an account has an overdue balance, failed payment, insufficient balance, chargeback, or suspected payment fraud.
13) Refunds
- Fees, setup charges, subscriptions, purchased minutes, usage charges, telephone-number charges, and third-party costs are non-refundable except when required by law or expressly stated in a written agreement.
- Unused account credits or minutes have no cash value and may not be transferred, sold, or redeemed for cash unless Mosik AI expressly agrees in writing.
- Approved refunds may be reduced by usage, third-party costs, processing fees, or amounts already delivered.
14) Customer content and data
- Ownership: As between you and Mosik AI, you retain ownership of content, scripts, prompts, documents, recordings, transcripts, customer data, and other materials you lawfully submit to the Services.
- Limited license: You grant Mosik AI a limited, non-exclusive license to host, copy, process, transmit, display, transform, and use your content only as reasonably necessary to provide, secure, maintain, support, and improve the Services.
- Required rights: You represent that you have all rights and permissions necessary to submit and process your content through the Services.
- Backups: You are responsible for retaining independent copies of important content and records unless a written agreement states otherwise.
- Removal: Mosik AI may remove, restrict, or disable access to content that violates these Terms, applicable law, third-party rights, or platform-safety requirements.
15) Mosik AI intellectual property
- Mosik AI and its licensors own the Services, software, interfaces, designs, branding, documentation, workflows, technology, and related intellectual property.
- These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Services during the applicable subscription or authorized access period.
- You may not copy, resell, sublicense, distribute, modify, create derivative works from, or commercially exploit the Services except as expressly authorized in writing.
- Suggestions, recommendations, or feedback may be used by Mosik AI without restriction or compensation, provided Mosik AI does not publicly identify you without permission.
16) Privacy and security
- Mosik AI’s collection and handling of personal information are described in the Privacy Policy.
- Mosik AI uses reasonable administrative, technical, and organizational safeguards designed to protect information.
- You are responsible for securing your devices, credentials, integrations, user permissions, exported data, and local systems.
- No internet service, communication network, storage system, or security measure can guarantee absolute security.
- You must promptly notify Mosik AI when you become aware of a security incident involving the Services or information processed through your account.
17) Healthcare and regulated information
- Do not submit Protected Health Information to the Services unless Mosik AI has expressly approved the use case and the parties have completed a Business Associate Agreement when required.
- The availability of security features does not automatically make every customer configuration or workflow compliant with HIPAA or another regulatory framework.
- Customers are responsible for access controls, minimum-necessary use, workforce training, patient notices, authorizations, retention, vendor review, and other requirements applicable to their use.
- Additional written terms may apply to healthcare, financial, governmental, educational, or other regulated use cases.
18) Confidentiality
- Each party may receive non-public information that is identified as confidential or that a reasonable person would understand to be confidential.
- The receiving party will use reasonable care to protect confidential information and will use it only for purposes related to the Services or the parties’ business relationship.
- Confidential information may be disclosed to personnel, contractors, professional advisers, and service providers who need the information and are subject to appropriate confidentiality obligations.
- Confidentiality obligations do not apply to information that was lawfully known without restriction, independently developed, publicly available without breach, or lawfully received from another source.
- A party may disclose information when legally required, subject to legally permitted notice and protective measures.
19) Service availability and support
- Mosik AI aims to provide reliable Services but does not guarantee uninterrupted, error-free, or continuously available operation.
- Scheduled maintenance, emergency maintenance, carrier interruptions, internet failures, third-party outages, security events, and circumstances beyond reasonable control may affect availability.
- Support methods, availability, response times, and included services may vary by account, subscription, plan, or written agreement.
- Mosik AI may impose reasonable limits to protect security, reliability, legal compliance, users, providers, and platform capacity.
20) Suspension and termination
- You may stop using the Services or close your account subject to outstanding payment obligations and applicable written agreements.
- Mosik AI may suspend, restrict, or terminate access when reasonably necessary because of nonpayment, fraud, abuse, security risk, unlawful activity, carrier action, provider restriction, violation of these Terms, or risk to the platform or others.
- When reasonable, Mosik AI will attempt to provide notice and an opportunity to correct a violation before termination. Immediate action may be taken when necessary to address urgent risk.
- Upon termination, your right to access the Services ends. Certain provisions survive, including payment obligations, ownership, confidentiality, disclaimers, limitations of liability, indemnification, and dispute provisions.
- Data export or deletion after termination is governed by the applicable plan, written agreement, technical availability, legal obligations, and our Privacy Policy.
21) Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
- Mosik AI disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and any warranties arising from course of dealing or usage of trade.
- Mosik AI does not guarantee that AI output will be accurate, complete, lawful, appropriate, uninterrupted, or suitable for a particular workflow.
- Mosik AI does not guarantee message delivery, call completion, carrier acceptance, campaign approval, telephone-number availability, integration compatibility, or uninterrupted third-party service.
- You are responsible for reviewing outputs, testing configurations, monitoring live workflows, maintaining backups, and implementing appropriate safeguards.
22) Limitation of liability
To the maximum extent permitted by law, Mosik AI and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, customers, opportunities, goodwill, data, or business interruption.
To the maximum extent permitted by law, Mosik AI’s aggregate liability arising from or relating to the Services or these Terms will not exceed the fees you paid directly to Mosik AI for the Services during the three months immediately preceding the event giving rise to the claim, or one hundred U.S. dollars if you paid no fees.
Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.
23) Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mosik AI and its owners, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, penalties, fines, costs, and reasonable legal fees arising from:
- Your use or misuse of the Services.
- Calls, messages, campaigns, recordings, content, or workflows initiated through your account.
- Your violation of these Terms or applicable law.
- Your failure to obtain required consent or honor an opt-out request.
- Your content, instructions, integrations, products, services, or business practices.
- Your infringement or violation of another person’s rights.
24) Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless another written agreement requires a different procedure, the state and federal courts located in Texas will have jurisdiction over disputes arising from these Terms or the Services. Each party consents to personal jurisdiction and venue in those courts.
25) Changes to these Terms
- Mosik AI may update these Terms to reflect changes in the Services, business practices, legal requirements, security needs, or provider requirements.
- The updated Terms will be posted on this page with a revised “Last updated” date.
- When required by law, Mosik AI will provide additional notice or request renewed agreement.
- An update to these Terms does not automatically expand the scope of previously granted SMS consent. Separate consent will be collected when required for materially different messaging.
26) Miscellaneous
- Entire agreement: These Terms, the Privacy Policy, applicable orders, and signed agreements constitute the entire agreement concerning the applicable Services.
- Severability: If a provision is found unenforceable, the remaining provisions remain effective.
- No waiver: Failure to enforce a provision does not waive the right to enforce it later.
- Assignment: You may not assign these Terms without Mosik AI’s written consent. Mosik AI may assign these Terms in connection with a merger, acquisition, reorganization, financing, asset transfer, or sale of the business.
- No third-party beneficiaries: These Terms do not create rights for a person who is not a party to them, except where expressly stated.
- Electronic communications: You agree that notices and agreements may be delivered electronically, including through email, the dashboard, or the website.
- Force majeure: Mosik AI is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, internet or carrier failures, governmental action, labor disputes, war, civil unrest, epidemics, provider outages, or cyberattacks.
